These Competition terms and conditions should be read together with, and are in addition to, Bauer Radio Limited's standard terms and conditions at: http://www.bauerlegal.co.uk/radio-competition-terms.html (the "General Terms"). Together these specific competition terms and conditions and the General Terms shall be referred to as the "Terms". Where there is a conflict between these terms and the General Terms, these terms shall prevail.
ITEM 1: COMPETITION NAME
"The Accumulator" running from the Start Date to the End Date as set out below (the "Competition").

ITEM 4: COMPETITION START DATE AND END DATE
Start Date: Monday 4th March 9:00am
End Date: Thursday 18th April 4:30pm*
Entries to the Competition will open on Monday 4th March at 9:00am.
*Please see Item 6 to understand how the End Date may be affected by a rollover.
The first round of the competition will take place on Monday 4th March between 4:30pm & 5:00pm. We reserve the right to broadcast the Competition at other times throughout the day during the broadcast schedule. As further described below, the Competition consists of multiple daily draws. Where there is no winner for a daily draw, all valid entries for that daily draw will be rolled over into the pool of entries for the following daily draw. One or more rollovers of a daily draw shall be referred to as a "Round". Where there is no winner of a daily draw and a rollover takes place, those entrants who have already entered that same Round are permitted to enter again for additional chances to play the Competition.
ITEM 5: COMPETITION DETAILS
At 9am each weekday (Monday to Friday) during the Entry Periods of the Competition, as set out below, the presenter(s) of the Station will announce on-air the prize amount ("Prize Amount") and artist ("Artist"), relevant to that daily draw of the Competition. For the avoidance of doubt, where there is a rollover of a daily draw due to an Entrant failing to win any of the Prize Amount, the Prize Amount on the following day shall not be lower than on the previous day of that Round.
Each Prize Amount and Artist will be valid for that day's draw only. The Artist will be the winning answer and the Prize Amount will be the cash prize that entrants are trying to win for that day (hereby known as the "Prize").
As set out above, the relevant Prize Amount and Artist for each day of the Competition will be announced on-air. However, we reserve the right to announce the Prize Amount and Artist at any time during the relevant day of the Competition. We may also advertise the current Prize Amount and Artist on the respective Station's website, social media or via an SMS marketing message or via any other medium at our absolute discretion.
After each Entry Period has closed, one entrant from all of the valid entries will be selected by automated random draw and will be contacted by the phone number provided with their entry. This may be live on air or off-air to be played out at a later time on-air. All callers are randomly selected in the same way and any off-air recording will only ever take place after the entries have closed.
In order to play the Competition, the number called must be answered within 5 rings. The 5 rings will be judged according to the Station audio recording (for the avoidance of doubt the sound of a "ring ring" shall count as one ring, not two). The entrant will be asked to play the Competition as soon as they answer the phone.
If someone other than the entrant answers the entrant's phone on their behalf when called, if the circumstances are deemed safe to do so by the presenter and/or production team (in their reasonable opinion) then the presenter may (but is not obliged to) ask the individual to pass the phone to the entrant. If this happens, the correct entrant must be on the phone with the presenter within 30 seconds of the request being made in order for the entrant to take part in the competition. If the entrant is not available after this time then we will terminate the call and the entrant will be ineligible to win. For clarity, should any person other than the entrant answer the call and play the competition they are not eligible to play or win either on their own behalf or on behalf of an entrant. If, after an entrant has won, it becomes apparent or we have reasonable reason to suspect that the individual who played the competition was not the correct entrant, we reserve the right to disqualify the entrant and withdraw any prize paid or payable to them or the individual. We reserve the right to terminate the call at any time if we believe it may be unsafe or irresponsible for the entrant to take the call or be passed the phone by another person, for example if the entrant is driving and cannot safely stop safely to take the call. Where a call is answered by someone other than the entrant, we are not obliged to ask to speak to the entrant and we reserve the right to terminate the call and draw another entrant to play the competition.
If the entrant is not in a position to play for any reason (e.g. not answering phone, the call being diverted to voicemail, or if an entrant is driving) then they will be unable to play the Competition, and no other entrant will be called.
If you are selected, you will be required to talk to the presenter(s) and your call will be recorded and played on-air (assuming there is no breach by you of these terms and conditions). If the call is unclear or inaudible due to a poor signal or for any other reason, you will not be eligible to win and we accept no liability in respect of this.
The entrant who is randomly selected to play will be asked to name the Artist relevant to that daily draw of the Competition.
If they give the correct Artist for that day then they will win the Prize.
The entrant will not win the Prize should they:
- fail to answer the phone at all; or
- fail to answer the phone within five rings (according to the station's audio); or
- give the incorrect Artist; or
- fail to say anything at all; or
- be disconnected for any reason beyond our control for a second time.
The presenter will take the first answer given by the entrant as the one and only answer.
If there are no words spoken (according to the studio's audio recording), the call goes to voicemail. Even if the pre-recorded voicemail messages starts with the correct Artist this will be judged as a failure to answer and the Prize will not be awarded. The answer given must be clearly audible to presenters and adjudicators and audible on the studio's audio recording. If this is unclear or inaudible due to a poor signal or any other reason, the entrant will be ineligible to win.
If the call is disconnected for any reason beyond our control after the entrant has answered but before they have been given the chance to provide their answer, we will attempt a single call back within 60 seconds of the call being disconnected. If however, the entrant does not answer the call back within 5 rings, or the call is disconnected for any reason beyond our control for a second time, the entrant will be ineligible to win and we accept no liability in respect of this.
If entrants appear in the judgement of the presenters and/or adjudicators to be driving illegally, they will not be eligible to win. Where there is any doubt in relation to whether or not an entrant has given the correct Artist or the prize should be awarded, we reserve the right to defer decision making to an off-air adjudicator to check the audio recording with reference to these terms and conditions. All our decisions relating to the Competition and/or awarding of prizes are final. No discussions or correspondence with entrants or any other person will be entered into.
Where there has been a winner for a daily draw, the new Prize Amount and Artist will be announced on-air for the next daily draw and you will need to enter again to be eligible to win. All previous entries for the daily draw which has been won will not be valid for future draws. Where there has not been a winner for a daily draw, there will be a rollover and a new Prize Amount and Artist will be announced on-air for the next daily draw. In the event of a rollover, you do not need to enter again in order to be eligible to win, but you are able to do so (as described at Item 4) if you would like to increase your chances of winning.
If no winner is declared, all entrants from the completed draw, and any other previous draws, where no winner was declared, will automatically be eligible for the next daily draw. For clarity, they will automatically be entered in to the next draw that takes place after 4:30pm the following weekday. A new Prize Amount may be announced for the next draw. This will be done in line with these terms and conditions.
ITEM 6: DRAW DETAILS
Entry to the first draw will open at 9:00am on Monday 4th March and close at 4:30pm on Monday 4th March.
Following the first draw, entry to the competition will open and close as follows (individually an "Entry Period", together the "Entry Periods"):
- Monday's Draw: opens at 9am Monday, closes at 4:30pm Monday
- Tuesday's Draw: opens at 9am Tuesday, closes at 4:30pm Tuesday
- Wednesday's Draw: opens at 9am Wednesday, closes at 4:30pm Wednesday
- Thursday's Draw: opens at 9am Thursday, closes at 4:30pm Thursday
- Friday's Draw: opens at 9am Friday, closes at 4:30pm Friday
The final draw will take place on Thursday 18th April at 4:30pm. There will be no rollover on this date, and if the entrant chosen to play does not answer their phone within 5 rings, or does not know that day's Artist, another entrant will be drawn at random and asked to play for that day's draw. This will continue until we have a winner and the prize is awarded.
If an entry is received after the closing time for a daily draw (but before the End Date), unless you receive a text message advising your entry has been unsuccessful (in which case you may still be charged), your entry will be valid for the following daily draw. For the avoidance of doubt, any entries received before or after the End Date (as stated above) will be invalid but you may still be charged.
The daily draws will take place each weekday (Monday to Friday) approximately between 4:30pm and 5:00pm, but only after entry to that daily draw has closed. Once the Entry Period has closed a random automated draw of all registered, qualifying entrants will take place and the Station shall call the phone number provided by the Entrant.
ITEM 7: ENTRANT RESTRICTIONS
You can enter each daily draw a maximum of 6 times via SMS (including free entries) and a maximum of 6 times online for free. Entrants must obtain permission from the bill payer before texting to enter the Competition.
The Competition is only open to people aged 18 and over who: (i) live in the United Kingdom, (ii) are not one of our employees (or living with, or related to, one of our employees) and (iii) are not one the employees of any company associated with the competition (or living with, or related to, one of the employees).
Entrants are only able to win a single prize throughout the duration of this Competition. There is no limit on the value of a single prize that may be provided to the individual winner of a Competition. However, no person may win more than one prize valued at £500 or more via any of our Competitions in any six (6) month period. A winner may continue to receive SMS messages in relation to the Competition and invitations to enter the Competition. For the avoidance of doubt, a winner should not enter the Competition again if they have already won in the previous six (6) months as they are ineligible to win. If a previous winner is drawn at random in a subsequent competition, or subsequent round of the same competition, they will be disqualified, and another entrant will be drawn at random. If it emerges after a winner has been awarded a Prize that they are a previous winner, in breach of these terms and conditions, they will be excluded and the Prize shall not be paid to them. If the Prize has already been paid, this must be returned immediately upon request. For clarity, it is possible to be drawn more than once to play the Competition between the Start Date and End Date, and if the entrant drawn has not previously won the Prize, they are eligible to play again.
In addition to previous winners, family relations of, or those living at the same residential address as, previous winners of this contest are ineligible to enter.
ITEM 8: ROUTES OF ENTRY AND COSTS
You can enter the Competition by sending an SMS message starting with the keyword WIN to 81215. If your message does not start with the valid keyword(s), or is not sent to the valid number, it will not be entered in to the draw. You will receive an automated SMS response to your SMS message confirming your entry. You can also enter online for free below.
You are responsible for all costs associated with entering this competition. Texts cost £2.00 (from the UK) + standard network rate. You must have permission from the bill payer before sending. Online entry is free.
Once you've sent an entry text, you'll receive an auto-response confirming your entry. You will then have the chance to text: WIN to 81215, again (at a further cost of £2.00 + standard network rate) and you will be entered 2 more times - your '3rd' entry being free. You must do this before the closing time of each daily draw, otherwise you will not be eligible for your '3rd' entry being free.
Entrants must enter during the Entry Periods of the Competition. Any entries received outside of the Entry Periods will not be entered but may still be charged. Bauer Radio Limited is not responsible for any latency experience or technical fault by your mobile phone network, which may delay or prevent the delivery of your text message to us.
For clarity, each competition Round is separate and the entry pool will be re-set after the conclusion of each Round (i.e. after there has been a winner), meaning that entrants would be required to enter again for any future draws or Rounds if they wished to be entered into the Competition again.
ITEM 9: WINNER ANNOUNCEMENT
Entrants who are randomly selected to play will be contacted personally after the Entry Period as stated above closes. By entering the Competition, you are automatically consenting to being called live on air at this time (where a call is not recorded off-air) and having your name and location announced on-air.
The name and the hometown of the winner may also be posted on the Promoter's website and / or social media platforms after they have been announced on-air.
ITEM 10: PRIZE DETAILS
The Prize will always be a cash amount that will be delivered to a winner paid in cash, by bank transfer or by cheque.
Delivery or payment of the Prize is subject to the winner providing personal identification and / or proof of address and to internal compliance checks. The Prize is non-transferable and cannot be exchanged. Payment of the Prize may take up to 28 days.
Where, it emerges after the Prize has been awarded that the entrant was in breach of these terms and conditions, we reserve the right to withdraw the Prize from that winner and they will not be entitled to any further reward or remuneration. We reserve the right to exclude individuals who breach our terms and conditions from entering our competitions.
ITEM 11: DATA PROTECTION
ITEM 12: INTELLECTUAL PROPERTY AND CONSENT
We will sometimes (at our discretion) telephone entrants and ask them to speak on-air. You have the right to refuse. If you consent, your voice will be recorded and you consent to this recording being used on our radio broadcasts. You agree that we will own this recording and that a copy of it will be stored for further exploitation, which may include promotion. You will not be put through to speak on-air if we think you are driving, intoxicated, likely to swear, or otherwise offend our listeners. Whilst on air for the purposes of this competition you must not use foul language, swear, say or do anything defamatory or illegal or say or do anything which would damage the reputation of Bauer, is offensive or inappropriate or which would cause us, or our listeners, harm. Failure to comply will result in disqualification, and if you have won the prize, this will be forfeited.
ITEM 13: OTHER CONDITIONS
We will only accept entries that comply with our terms and conditions and we may disqualify you if we know or suspect that you have breached them. Our decision on the selection of the winner is final and we won't engage in any correspondence or discussion about this or about the operation of this competition. We are not responsible for any network or technical issues you experience, such as latency of your mobile phone network, which may delay or prevent your participation or cause you to lose the competition if on-air. We have the right to cancel, amend, terminate or suspend this competition if forced to do so due to circumstances outside our control.
